14TuesdayMay202014SaltRiverFirstNationRESERVETRESPASSBY-LAWWHEREAStheSaltRiverFirstNationisasignatorytoTreatyNo.8signedJuly171899withHerMajestytheQueenandalsoasignatorytotheSaltRiverFirstNa-tionTreatySettlementAgreementsignedJune222002withHerMajestytheQueeninrightofCanadaWHEREASbyOrders-in-CouncildatedSeptember52008July302009andMay232011HerMajestytheQueensetasidelandstobeknownastheSaltRiverFirstNationReserve195WHEREAStheCounciloftheSaltRiverFirstNationhasthetraditionalgovernanceoftheSaltRiverFirstNationandalsoexercisesallofthepowersofacouncilofthebandundertheIndianActofCanadaincludingthepowertomakeby-lawsundersection811npqandrofthatActWHEREASRiverFirstNationReserve195andtheprotectionoftheReservetoregulatetheconductandactivitiesofpersonsenteringupontheReserveandtoprovidefortheremovalfromtheReserveofpersonstrespassingontheReserveorfrequentingthereservesforprohibitedpurposesNOWTHEREFOREtheCounciloftheSaltRiverFirstNationherebyenactsthefollowingby-lawTITLE1.ThisBy-lawmaybecitedasTheSaltRiverFirstNationReserveTrespassBy-Law.DEFINITIONS2.InthisBy-LawCouncilmeanstheCounciloftheSaltRiverFirstNationhawkingandpeddlingmeansandincludesgoingfromplacetoplaceontheReservetobuysellorotherwisedealinwaresormerchandiseorservicesorofferingorexposingforsaleontheReservetoanypersonbymeansofsamplespatternscutsblueprintsorpicturesmerchandisetobeafterwardsdeliveredorshippedontotheReserveCouncilforthepurposeofmaintaininglawandorderontheReserveandforpurposesofclarityitincludesmembersoftheRoyalCanadianMountedPoliceParksCanadaLawmeansthelandssetasidefortheSaltRiverFirstNationasSaltRiverFirstNationReserve195byOrders-in-CouncilNo.PC2008-1666No.PC2009-1244PC2011-0752andsuchotherOrders-in-CouncilthatmaybeissuedbyHerMajestytheQueenasrequiredinaccordancewiththeSaltRiverFirstNationTreatySettlementAgreementandincludesforclaritythelandsformerlyknownastheSaltPlainsReserve195.TRESPASS3.NopersonshalltrespassontheReserve.PROHIBITEDPURPOSESANDTRESPASS4.ApersonotherthanapersonreferredtoinSection5whoconductsanyofthefollowingactivitiesontheReserveb.Hawkingorpeddlingofwaresormerchandisec.Loiteringd.Campinge.Operatinganall-terrainvehicleATVorsnowmobileorothermotorizedornon-motorizedvehicleontheReservef.Dumpingrefuseorwasteandg.AnyotheractivitythatisprohibitedbyfederalorterritoriallaworbySaltRiverFirstNationBy-LawshallbedeemedtobefrequentingtheReserveforaprohibitedpurposeandtobetrespassingontheReserve.LAWFULJUSTIFICATION5.Section3andSection4donotapplytothefollowingpersonswhohavearightofaccesstotheReservea.MembersoftheSaltRiverFirstNationexceptthattheyhavenorightofaccesstothecabinlocationsorareaswithintheReservethatCouncilhasdesignatedb.ApersoninvitedontotheReservebyamemberoftheSaltRiverFirstNationandwhobeingaccompaniedbythatmembersharesthatmembersrightofaccessc.ApersonwhohasenteredontotheReservewhoiscarryingCouncilswrittenauthorizationandisconductinghimselfinaccordancewithCouncilswrittenauthorizationd.ApersonauthorizedbyfederalorterritoriallaworbySaltRiverFirstNationBy-Lawe.ApersontravellingonapublicroadonorthroughtheReservef.ApersonparticipatinginactivitiesontheReservethatareauthorizedbyCouncilandENFORCEMENTANDPENALTIESimmediately.toremovethepersonfromtheReserve.AnypersonwhofailstocomplywithanordermadeunderSection6orSection7INEFFECTASOFMAY112014.
